Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Estimora platform (“the Service”).

The Service is operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Estimora is a SaaS platform that allows users to:

  • create software project estimates
  • structure scope into modules and tasks
  • assign effort, pricing, and roles
  • generate client-ready offers
  • collaborate within workspaces
  • export data to external tools (e.g. Jira, ClickUp)

We reserve the right to modify, improve, suspend, or discontinue the Service (or any part of it) at any time.

3. Accounts

3.1 Account Creation

To use the Service, you must create an account and provide accurate information.

You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activities under your account

3.2 Workspace Model

The Service operates on a workspace-based model.

  • Each workspace represents an organization
  • Users collaborate within workspaces
  • Workspace owners/admins manage access and permissions

Workspace owners are responsible for all actions performed by users within their workspace.

3.3 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts.

4. Acceptable Use

You agree to use the Service only for lawful purposes.

You must NOT:

  • attempt to gain unauthorized access to the Service
  • reverse engineer, copy, or exploit the Service
  • use the Service to build a competing product
  • upload illegal, harmful, or malicious content
  • introduce malware, viruses, or harmful code
  • abuse, overload, or disrupt the system
  • scrape or extract data in an automated manner without permission

5. User Data & Content

5.1 Ownership

You retain full ownership of all data you input into the Service, including:

  • estimates
  • project data
  • business information

5.2 Responsibility

You are solely responsible for:

  • the accuracy of your data
  • verifying all estimates and outputs
  • any business decisions based on the Service
  • any offers or pricing shared with your clients

5.3 License to Operate

You grant us a limited, non-exclusive license to store, process, and display your data strictly for the purpose of providing the Service.

6. Subscription & Payments

6.1 Plans

The Service may offer subscription plans (e.g. Free, Pro, Business).

  • Features and limits depend on the selected plan
  • Free plans may be limited or modified at any time

6.2 Payments

Payments are processed via Stripe.

By subscribing, you agree to:

  • Stripe's terms and conditions
  • recurring billing where applicable

6.3 Billing

  • Subscriptions renew automatically unless canceled
  • You may cancel at any time
  • No refunds are provided unless required by law

6.4 Plan Changes

We may change pricing or plan features. Users will be notified of material changes in advance.

7. Availability of Service

We aim to provide reliable access, but:

  • we do NOT guarantee uninterrupted availability
  • we do NOT guarantee error-free operation

The Service may be unavailable due to:

  • maintenance
  • infrastructure issues
  • third-party failures

We may suspend or discontinue the Service at any time without liability.

8. Third-Party Services

The Service integrates with third-party providers, including:

  • Stripe (payments)
  • Google Analytics (analytics)
  • external tools (e.g. Jira, ClickUp)

We are not responsible for third-party services, their availability, their performance or behavior.

Use of such integrations is at your own risk.

9. Intellectual Property

All rights to the Service, including software, design, and branding, remain the property of HK Hubert Kowalewski.

You may NOT:

  • copy
  • distribute
  • modify
  • reverse engineer

any part of the Service.

10. No Warranty

The Service is provided “as is” and “as available”.

We make no warranties regarding:

  • accuracy of estimates
  • completeness of outputs
  • fitness for a particular purpose
  • reliability or availability of the Service

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • lost profits
  • lost data
  • business losses
  • incorrect estimates
  • decisions made based on the Service

Total liability is limited to the amount paid by you in the last 12 months.

12. Data Loss Disclaimer

We take reasonable measures to protect your data, but we do not guarantee that data will never be lost or corrupted.

You are responsible for maintaining backups where necessary.

13. Termination

We may suspend or terminate your account if:

  • you violate these Terms
  • you misuse the Service
  • termination is required by law

You may stop using the Service at any time.

14. Data & Privacy

Your personal data is processed in accordance with our Privacy Policy.

15. Changes to Terms

We may update these Terms at any time.

If changes are significant, we will notify users.

Continued use of the Service constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Poland.

Any disputes will be resolved by courts in Poland.
